Terms of Service

1. Acceptance of Terms

By creating an account or using Poolaxy, you agree to these terms. If you do not agree, do not use the service.

2. What Poolaxy Does

Poolaxy is a channel health service. It connects opted-in WhatsApp numbers to a shared warming pool. AI-generated conversations flow between matched accounts daily to help maintain healthy activity patterns. Poolaxy does not send marketing messages on your behalf.

3. Account Registration and Security

You must provide accurate information when registering. You are responsible for maintaining the security of your account credentials. Do not share your password or API key. Notify us immediately if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Report pool messages as spam on any platform
• Block pool partners on WhatsApp or any other channel
• Use Poolaxy for illegal purposes or to violate any platform's terms of service
• Attempt to identify or contact pool partners outside the system
• Use automated tools to abuse the API beyond rate limits

5. Pool Participation Rules

By opting a number into the pool, you consent to that number sending and receiving automated warm-up messages with anonymous pool partners. Poolaxy operates a strike system. Violations such as reporting pool messages as spam or blocking pool partners result in strikes. Strike 1: 7-day suspension. Strike 2: 30-day suspension. Strike 3: permanent ban. Appeals can be submitted from the warming page.

6. Subscription and Billing

Paid plans are billed monthly or annually. You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods or used pool exchanges. Plan downgrades take effect at the next billing cycle.

7. Intellectual Property

All Poolaxy content, code, and branding are the property of Jordan Digitals. You may not reproduce, distribute, or create derivative works from Poolaxy without written permission.

8. Limitation of Liability

Poolaxy helps maintain account health but makes no guarantees about delivery rates, platform standing, or account safety. We are not responsible for actions taken by WhatsApp or any other platform against your accounts. Use Poolaxy at your own discretion.

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time from the Settings page.

10. GDPR and EU User Rights

If you are located in the European Union, you have rights under the General Data Protection Regulation (GDPR). These include the right to access, rectify, erase, and port your personal data. To exercise these rights, email hello@poolaxy.com. Data controller: Jordan Digitals, hello@poolaxy.com.

11. Changes to Terms

We may update these terms. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance.
